Stuart Alderoty, Chief Legal Officer at Ripple, is urging for an investigation into the controversial speech delivered by Bill Hinman, a former official of the Securities and Exchange Commission (SEC). Alderoty took to Twitter to shed light on the SEC’s lawsuit against Ripple and revealed undisclosed information related to Hinman’s influential speech.
In a series of tweets on June 13, Alderoty demanded an investigation into the motivations behind Hinman’s speech, which occurred in 2018. Following the public release of documents, it was revealed that Hinman delivered the speech despite receiving warnings from other SEC divisions.
During the Yahoo Finance All Markets Summit, Hinman provided guidance on the SEC’s regulation of digital assets, stating that certain digital assets, like Bitcoin and Ethereum, should not be considered securities. Alderoty argued that the newly released documents indicated Hinman disregarded warnings from other SEC officials and presented analysis with no legal basis, causing confusion within the cryptocurrency industry regarding the classification of securities.

Alderoty emphasized that unelected bureaucrats should strictly apply the law rather than create new ones. He asserted that Hinman’s speech should not be referenced in discussions concerning whether a token is a security or not.
Ripple CEO Brad Garlinghouse joined Alderoty in criticizing the SEC, describing the decision to proceed with the speech despite significant pushback as “unconscionable.” Additionally, the Office of General Counsel (OGC) found that one of Hinman’s criteria, relating to ownership or interest in a digital asset, was inappropriate under the law, yet Hinman included it in his presentation.
Observers raised concerns about Hinman’s failure to address the fundamental issue of whether a digital asset meets the legal criteria of security, opting instead to focus on the advantages of SEC regulation. This omission highlighted a loophole in the rules that Hinman overlooked.
After these disclosures, Alderoty demanded the immediate removal of Hinman’s remarks by the SEC. He stressed the importance of conducting a thorough investigation to uncover the influences and conflicts that led to the SEC’s endorsement of Hinman’s speech.
